Dimple Yadav refused the notice of the High Court and did not appeared in the High Court. Consequently the High Court ordered a one-sided verdict. Looking this order Smt. Thereafter , the candidate and the party chief, Shri Bharat Gandhi , received threat to life. Shri Vishwatma the Founder of the VPI filed a writ petition in Hon'ble Supreme Court and argued in person for a CBI inquiry and police protection to himself and to the candidate. The Supreme Court on January 22, 2013 refused a CBI probe but ordered the Director General of Police of Uttar Pradesh to provide police protection to Sh. Vishwatma and to his party candidate. The Akhilesh government did not allow the DGP to comply the order of Apex court. Seeing that justice was not served by the Supreme Court, Shri Vishwatma filed a petition in the National Human Rights Commission on 11th November, 2013 seeking protection for himself. He also sought a CBI inquiry.
Uttar Pradesh government's orgy after National Human Rights Commission orders for probe -
On March 2, 2015, the National Human Rights Commission quashed the entire investigation report of the Uttar Pradesh Police and ordered the Director General of Police to conduct an inquiry at its own level and send the report. On receiving the commission's order, Rishi Pal Singh Yadav, ASP kanpur dehat, was appointed as the investigating officer. ASP also committed crime in place of investigation. ASP forced the accused and criminals to raid the house of witnesses and make arbitrary statements. Party candidate Prabhat Pandey was kidnapped again from his house on April 27, 2015. Unbearable tortures were inflicted. Hundreds of plain pages were signed. ASP forced to record statements of their choice. Witnesses forced to join the Samajwadi Party. A rape case was registered against the victim of abduction on the instructions of Gayatri Prajapati, the then minister of UP government. An attempt was made to implicate Sh. Vishwatma in the case. Prabhat Pandey broke down and was forced to join party of offenders. But, as the phone was recorded, Shri Vishwatma handed over the CD to the NHRC. The Commission ordered the next order on October 16, 2016 and the Commission sought a report on the proceedings taken on the orders of the Supreme Court. But the Akhilesh Yadav government refused sending the report to the Director General of Police.
Several attacks by goons of Samajwadi Party on Sh. Vishwatma -
Meanwhile, Vishwatma's Lucknow residence was attacked by armed men on July 4, 2015. But Sh. Vishwatma was in Delhi, so he survived. The attack was reported to the National Human Rights Commission. The Commission, while ordering 24th February, 2016, asked Uttar Pradesh Home Secretary Devashish Panda to conduct a CBCID inquiry into the entire matter and provide security to Sh. Vishwatma and his family and submit the report within six weeks. But the Akhilesh Government did not allow CB CID to conduct an inquiry. CB CID sent a letter to Shri Vishwatma on 8th September, 2016 stating that agency is not getting permission from the government to conduct an inquiry. Attempts to murder of Sh. Vishwatma were made 4 times. This information was handed over by Vishwatma to the Human Rights Commission. The only way before the National Human Rights Commission was to arrest The Home Secretary of Uttar Pradesh, Shri Debashish Panda, by issuing an arrest warrant and calling him to Delhi. But by then the Government changed and on 4th April, 2017, an order was issued by the Yogi Government and CB CID was allowed for investigation. 15 days later, on 19th April, the Home Secretary issued a fresh ordering police protection to Shri Vishawatma, who is yet to get security. Because Akhilesh's officers and staff were still working in the intelligence department who were repeatedly sending false reports to the government in the name of conducting investigation on security threats.
A.P. CBCID begins probe into Kannauj abduction case as soon as state government approves it -
CBCID started inquiry and recorded statement Sh. Vishatma first at his residence in Jankipuram extension Lucknow. In his statement, Sh. Vishwatma said that the entire conspiracy in the Kannauj abduction case was hatched by former Chief Minister Akhilesh Yadav to make his wife an unopposed MP from Kannauj Lok Sabha constituency. He added that Akhilesh Yadav did not want to take any risk again after losing election by Rajbabbar in Firozabad. The VPI chief said that his party's Prabhat Pandey, Sadesh Yadav and Ram Singh Lodhi were kidnapped when Prabhat Pandey was on his way to file his nomination papers as party's representative for the Kannauj Lok Sabha constituency bye poll.
Joint conspiracy of election officials and Samajwadi Party behind Kannauj abduction case -
Petitioner Sh. Vishwatma said the kannauj police was openly helping the kidnappers. The then District Collector Silva Kumari J. was the guardian of the entire kidnapping case and was working as a representative of Akhilesh Yadav instead of the Election Commission. Mr Vishwatma has told CB CID that all the criminals were engaged in white kurtas and pyjamas and white pant-shirts to kidnap them. Perhaps it was done so that it was difficult to identify them. The kidnapping scolded the people who grabbed the nominees and tore their nomination papers into pieces and blew them up in the air. Then came the turn of local police officers and Kotwal, who would push the nominees and their proposers into the sparkling cars parked in the Kannauj Collectorate complex with the Samajwadi Party flag on them. The criminals already sitting in the car used to put their pistols on the foreheads of the victims of abduction and force them to sit under the seat of the car. This was followed by a towel on the eyes of the victims of the kidnapping so that they could not identify any person or any place. The driver of the car would then take the abductors to a cold store where the gumtied on their eyes was opened and watered. The blindfolds were then retied and taken to an undisclosed location where hundreds of people had been kidnapped and kept for a week. The last date for filing nomination papers was on 6th June, 2012. That evening, all the victims of the kidnapping were taken to remote forests and released. However, it is a matter of investigation whether some people were killed or not.
Vishwatma directly clashed with Samahwadi Party for political reform -
Sh. Vishwatma's proposal for political reforms was tabled in Parliament by 137 MPs from almost all parties. The Standing Committee of the Rajya Sabha had also recommended implementation of some of Sh. Vishwatam's points in 2011. Nevertheless, when the law was not enacted, Sh. Vishwatma's countrywide supporters formed the Voters Party International. The party is working on an agenda to remove crime from politics. So the party approached some of the victims of the kidnapping and demanded joint legal action. But the victims of the kidnapping were so afraid of the tortures inflicted during the kidnapping that no one dared to raise their voice in the police or the court against this criminal offence. In the end, the voters party international had to fight this legal battle alone. Even those in the party who were authorized to take legal action, Akhilesh Yadav sent his armed criminals to their homes and intimidated them and forced them to withdraw from legal proceedings. In the end, Sh. Vishwatma himself had to take over the entire responsibility of legal proceedings. That is why Mr. Vishwatma himself argued in the Supreme Court on 22nd January, 2013 over the Kannauj abduction case and took all legal proceedings in the National Human Rights Commission in his own name. Though Akhilesh Yadav attacked him 4 times for this, he was safe three times incidentally.
Permission of Inquiry was granted to CBCID in 2017 after change of government -
National Human Rights Commission orders CBCID probe into Kannauj abduction case on February 24, 2016. But under pressure from Akhilesh Yadav, Home Secretary Devashish Panda refused to comply with the commission's order. This information was given by CBCID through a letter dated 8th September, 2016 to the National Human Rights Commission and to the petitioner Sh. Vishwatma when the information was sought under right to information. After receiving the information furnished by CBCID, the Commission was about to issue the next order, but by then the Government in the State had changed. The Adityanath Yogi government issued an order on April 3, 2017 in compliance with the Human Rights Commission order allowing CBCID of the state to investigate the Kannauj abduction case and the crimes of attacks on Sh. Vishwatma. CB CID headquarter has authorized the IG, Kanpur to conduct the inquiry. As per the directions of the Commission, action is also being taken by the Ministry of Home Affairs of the State to provide police protection to Sh. Vishwatma.
